Texas Property Distribution
In a Texas divorce action, property acquired by either spouse during the marriage is
presumed to be community property will be divided equally, unless a
party can show that the property is separate property or the court finds that
equal division of the community property would be unjust. The court may also
divide property acquired by either spouse while residing outside of Texas which
would have been community property if they had acquired it while residing in
Texas. In dividing property, the Texas divorce Court must give due regard to the rights of
each party and any children.
