North Carolina Divorce Residency Requirements

To file for a North Carolina divorce, either spouse must have been a resident of the State for at least 6 months prior to filing for divorce.

North Carolina Divorce Filing Requirements

A North Carolina divorce action may be filed for in the county of residence of either spouse.

North Carolina Divorce Grounds

The grounds for a North Carolina divorce are:

  • Living separate and apart without cohabitation for 1 year;

  • confinement for incurable insanity for 3 years; or

  • incurable mental illness based on examinations for 3 years.
