New Mexico Divorce Residency Requirements

To file for a New Mexico divorce, one of the parties must have been a resident of the State for at least 6 months immediately preceding the filing and have a home in New Mexico.

New Mexico Divorce Filing Requirements

The dissolution of marriage may be filed in any county where either spouse resides.

New Mexico Divorce Grounds

The grounds for a New Mexico divorce are:

  • Incompatibility because of discord and conflicts of personalities such that the legitimate ends of the marriage relationship have been destroyed preventing any reasonable expectation of reconciliation;

  • adultery;

  • abandonment;

  • cruel and inhuman treatment; and

  • incompatibility.
