Nevada Child Custody

Nevada child custody will be awarded based upon the best interests of the child. In determining best interests, a Nevada Court will consider the following factors:
  • the preference of the child, if the child is of sufficient age and capacity;

  • the wishes of the parents. No preference is to be given because of parent's sex;

  • whether either parent has committed domestic violence; and

  • other relevant factors.

If the parties have agreed to share joint custody, a Nevada Court will presume that such an arrangement is in the best interests of the child. A Nevada Court will also presume that custody should not be awarded to a parent who has committed domestic violence.
