Nebraska Divorce Residency Requirements

To file for divorce in Nebraska, one of the parties must have been a resident for at least one year or the marriage must have been performed in Nebraska and one of the parties has lived in the State for the entire marriage.

Nebraska Divorce Filing Requirements

The divorce action may be filed in a county where either spouse resides.

Nebraska Divorce Grounds

The grounds for divorce in Nebraska are as follows:

  • an irretrievable breakdown of marriage; and

  • a lack of mental capacity at the time of the marriage. 

Expedited Nebraska Divorce Procedure

 The parties may file a joint petition for dissolution of the marriage.
