Montana Divorce Residency Requirements

To obtain a Montana divorce, one of the parties must be a resident of Montana for 90 days immediately prior to filing for divorce.

Montana Divorce Filing Requirements

 The Montana divorce petition must be filed in the county where the party filing for the divorce has been a resident for the previous 90 days.

Montana Divorce Grounds

The only ground for Montana divorce contains three factors:

  • is an irretrievable breakdown of the marriage and serious marital discord which adversely affects the attitude of both spouses towards the marriage; 

  • no reasonable prospect of reconciliation; or

  • living separate and apart for 180 days prior to filing. All three of these factors must be met to satisfy the grounds for dissolution of marriage. 

Expedited Montana Divorce Procedure

 The parties may file a joint petition for the Montana divorce.
