Massachusetts Child Custody
Massachusetts child
custody may be awarded to either party. Each party's right to
custody will be presumed equal absent marital misconduct. A Massachusetts Court's
child custody determination will be based upon
the welfare and happiness of the child.
Absent
a finding by the Court that joint custody is not in the best interests of the
child, the Court may awarded the
parties joint custody if they agree to such an arrangement. If the parties
cannot agree upon a custodial
arrangement and request a form of shared custody, a Massachusetts Court will require
the
parties to submit a shared parenting plan to the court.
