Kansas Divorce Residency Requirements:

To file for Kansas divorce, either party must have been a resident of the State for 60 days immediately before filing for divorce.

Kansas Divorce Filing Requirements:

A Kansas divorce may be filed for in a county where either spouse resides. 

Kansas Divorce Grounds:

Kansas divorce may be granted upon the following grounds: 

  • incompatibility; failure to perform a material marital duty or obligation; and 

  • incompatibility due to mental illness.
