Idaho Divorce Residency Requirements

The party filing for an Idaho divorce must be a State resident for at least six weeks immediately prior to filing for divorce.

 

Idaho Divorce Filing Requirements

An Idaho divorce action should be commenced in either the county where the non-filing party resides or, if the non-filing party is not a State resident, the county where the filing party resides.

 

Idaho Divorce Grounds

The grounds for Idaho divorce are as follows:

  • irreconcilable differences;

  • living separate and apart without cohabitation for a period of 5 years; 

  • adultery;

  • permanent insanity;

  • conviction of a felony;

  • willful desertion;

  • cruelty;

  • willful neglect; and

  • habitual drunkenness.
