Alaska Property Distribution




The Court will divide marital property in an equitable manner in an Alaska Divorce. Marital fault cannot be considered in dividing marital property. An Alaska Court will consider the following factors: 

  • the length of the marriage;

  • the age and health of the parties;

  • the earning capacity of each spouse;

  • the educational backgrounds, training, employment skills, work experiences, length of absence from the job market, and custodial responsibilities for children during the marriage;

  • the financial condition of each spouse;

  • the parties conduct regarding their assets;

  • the desirability of awarding the family home to the spouse with primary physical custody of children;

  • the time and manner of acquisition of their property;

  • the income producing capacity of the property and its value; and 

  • any other relevant factors.
